Tax for increasing silence and security in carrying out economic activities in Constanta, Mamaia and Sat Vacanță could be annulled by Court – USCOV | Attorneys at law gets involved in supporting NGO activity
The first step was made by ACIA (Constanța Takes Attitude Association) with the legal support of Uscov | Attorneys at Law.
Uscov | Attorneys at law considers that special taxes can be established by the Local Council only under the following conditions, which were not met by the Appendix 5 to the Local Council Decision nr. 246/18.12.2014:
- to establish a new local public service, for whose function the special tax is established;
- the new public service must be set in the interests of natural and legal persons benefiting from local public service;
- the fee must correspond to the provision of a public service by the public authority;
- the special tax must be collected only from natural and legal persons benefiting from these public services;
- the special taxes must be used only for the purposes for which they were established, namely to cover costs incurred for setting up local public services and to finance maintenance and operation of these services
